01.Nature and purpose of this notice
This Risk Warning aims to present clearly and transparently the main risks associated with using EFFAP products and services related to financial market trading, including the Expert Advisor and Copy Trade. Reading this document is essential before using the services, and no information presented by EFFAP should be interpreted as a guarantee of results, a promise of profitability, or an individual investment recommendation.
02.Risk of capital loss
Trading in financial markets involves the possibility of financial losses and, depending on the instrument, strategy, margin used, and account conditions, the user may lose some or all of the funds allocated to trading. Users should only use funds whose potential loss is compatible with their financial capacity and should never assume that previous positive results will necessarily be repeated.
03.Market volatility
Asset and currency pair prices may change rapidly and significantly due to economic, political, financial, and geopolitical factors, unexpected events, monetary authority decisions, and changes in market conditions. High volatility may cause price movements greater than expected and significantly affect trading results. The CVM characterizes the Forex market as highly volatile and high risk.
04.Leverage and margin risk
Using margin or leverage allows control of positions worth more than the capital initially allocated to a trade, increasing both potential gains and potential losses. Small adverse market changes may significantly affect available capital and, under certain conditions, cause positions to close or substantial losses. The CVM emphasizes that risk increases significantly when trades are conducted on margin.
05.Execution risk
Trades may be executed under conditions different from those observed when the order was requested or in the reference strategy. Factors such as volatility, liquidity, spread, slippage, latency, execution speed, and broker conditions may influence the price and actual outcome of a trade. Therefore, it is not possible to guarantee that an order will be executed at exactly the expected price.
06.Liquidity risk
Under certain market conditions, some assets or currency pairs may experience reduced liquidity, wider spreads, or execution difficulties. Lower liquidity may make opening or closing positions more difficult and result in less favorable execution prices for the user.
07.Market risk and extraordinary events
Economic, political, and geopolitical events, central bank decisions, indicator releases, financial crises, regulatory changes, conflicts, natural events, or other unexpected occurrences may cause substantial market movements. These events can happen quickly and cannot be fully predicted or controlled by EFFAP.
08.Expert Advisor risk
The Expert Advisor is an automation tool intended to execute strategies according to its programming and the parameters defined for its use. Automated operation does not eliminate the risks inherent in financial trading and does not guarantee positive results. Technical failures, unsuitable settings, platform unavailability, unstable connections, changes in market conditions, or incompatibilities may affect trade execution.
09.Configuration and use risk
Expert Advisor performance and operation may depend on correct installation, configuration, and use of the software, MetaTrader 5 platform, broker, and technological environment used by the user. Incorrect settings, unauthorized changes, or use under conditions different from those recommended may compromise the expected operation of the tool.
10.Copy Trade risk
Copy Trade involves replicating trades executed by a reference account or strategy and does not guarantee that the user will achieve the same results as the reference account. Differences in execution, balance, position sizes, liquidity, spreads, slippage, latency, connection times, and broker conditions may produce different results.
11.Risk of performance differing from the reference strategy
Even when trades are copied according to the parameters established by the service, results in the user’s account may differ from the performance shown by the reference account. Historical or current strategy results do not guarantee future performance and should not be interpreted as a forecast of results.
12.Risk of technological failures
Products and services depend on technological infrastructure, including computers, servers, the internet, trading platforms, communication systems, brokers, and other third-party services. Interruptions, connection failures, server unavailability, software problems, updates, maintenance, or technical events may prevent or delay the execution of certain trades.
13.Third-party and broker risk
Using the services may involve brokers, platforms, technology providers, and other third parties. EFFAP does not fully control these environments and cannot guarantee the availability, stability, execution, or continuity of third-party services. Users should carefully assess the institution used to hold their account and conduct their trades.
14.Regulatory and jurisdictional risk
Rules applicable to financial products, derivatives, Forex, Copy Trade, automation, and related services may vary by the user’s country or territory and may change. Users are responsible for verifying the legality and conditions applicable to using the services in their jurisdiction. In Brazil, the CVM states that Forex transactions may qualify as derivatives and securities and warns of the need to verify the regulatory status of intermediaries and offerings.
15.Risk of unauthorized intermediaries
Using unauthorized intermediaries or those whose regulatory status has not been properly verified may add significant risks, including difficulties obtaining protection, fraud, loss of funds, and difficulties obtaining compensation. The CVM warns that lack of registration or authorization may increase these risks and recommends that investors verify the regulatory status of the provider or intermediary beforehand.
16.No guarantee of profitability
EFFAP does not guarantee profitability, minimum returns, absence of losses, or any specific financial outcome from using its products and services. Past results, historical records, charts, simulations, backtests, performance demonstrations, or any other data presented do not guarantee future results.
17.No individual recommendation
Information provided by EFFAP about its products, strategies, operation, or performance does not constitute an individual investment recommendation, financial advice, a promise of returns, or an indication that a particular trade is suitable for any user’s profile, objectives, or financial situation. The decision to use the services and trade belongs exclusively to the user.
18.Responsibility for the decision to trade
Users are solely responsible for their decisions regarding product use, broker selection, trading capital, tool configuration, and account maintenance. Before using the services, users should assess their knowledge, experience, objectives, and ability to bear potential losses.
19.Past results do not guarantee future results
Any historical performance presented by EFFAP, a strategy, a reference account, or any other product-related material should be considered solely as historical information. Future market conditions may differ, and there is no guarantee that previously achieved results will be reproduced.
20.Final considerations
Using EFFAP products and services involves risks that must be understood and considered before purchasing or using them. By proceeding, users declare that they are aware of the possibility of financial losses and acknowledge that no technology, strategy, performance history, or automation service eliminates the risks inherent in financial market trading.
