01. General provisions
These Terms of Use establish the general conditions applicable to access to and use of products and services provided by EFFAP, including the Expert Advisor and Copy Trade service. By accessing the website, creating an account, purchasing a license, or using any service offered, users declare that they have read, understood, and agreed to the provisions established in this document.
02.Identification of EFFAP
EFFAP is a brand used by JM Investimentos e Tecnologia LTDA, a company incorporated in Brazil, responsible for providing the products and services presented on this website. For these Terms, references to “EFFAP”, “we”, “our”, or “company” correspond to JM Investimentos e Tecnologia LTDA, as applicable.
03.Definitions
To facilitate understanding of these Terms, “EFFAP” refers to the brand and services provided by the company; “Expert Advisor” or “EA” refers to software developed for use in the MetaTrader 5 platform; “Copy Trade” refers to the service that copies trades from a reference account or strategy into the user’s account through third-party infrastructure and services; “user” refers to a person accessing, purchasing, or using the services; “license” refers to the right to use the software during the purchased period; and “broker” refers to the institution or trading platform used by the user.
04.Acceptance of the Terms
Access to and use of EFFAP products and services are conditional on acceptance of these Terms of Use and other policies applicable to the website. Users who disagree with any provision of this document must stop using the services and refrain from further purchases.
05.Eligibility and territorial restrictions
EFFAP services are intended for users legally authorized to use products and services relating to the activities offered in their respective country or territory. Users are responsible for verifying whether purchasing and using the services are permitted by the laws and regulations applicable to their jurisdiction. Use is prohibited where a legal, regulatory, or territorial restriction applies.
06.EFFAP Products and Services
EFFAP provides products and services relating to automation and monitoring of financial market trading, including the Expert Advisor for MetaTrader 5 and Copy Trade. Each product has its own features, usage conditions, purchase methods, and responsibilities, which users must observe before purchase.
07. Expert Advisor
EFFAP’s Expert Advisor is software developed to assist automated trade execution through MetaTrader 5, according to the strategy and parameters provided by EFFAP. The software is a technological tool and does not itself constitute a promise of profitability, a guarantee of results, an individual investment recommendation, or management of the user’s financial funds.
08.License to use
Purchasing the Expert Advisor grants users a limited, personal, non-exclusive, non-transferable license valid during the purchased period, solely for the purposes provided in these Terms. The license does not constitute a sale or transfer of software intellectual property and does not authorize users to copy, modify, distribute, sublicense, resell, provide to third parties, reverse engineer, or commercially exploit the software outside EFFAP’s established conditions.
09.Free trial and activation
When provided by EFFAP, the Expert Advisor’s free trial will have the duration and conditions stated when offered. Software access may depend on activation, license identification, technical compatibility, MetaTrader 5, and other requirements stated by EFFAP. The trial period does not guarantee performance or future results.
10.Copy Trade
Copy Trade allows trades executed in a reference account or strategy to be replicated in the account linked by the user, according to the configuration and infrastructure used by the service. Copy Trade does not constitute direct management of user funds by EFFAP and does not guarantee that copied trades will have the same prices, times, results, execution, or conditions observed in the reference account.
11. Relationship with brokers and third parties
Product and service use may depend on brokers, platforms, servers, technology providers, payment methods, and other third-party services. EFFAP does not fully control these environments, and users acknowledge that unavailability, rule changes, delays, technical failures, order execution, spreads, liquidity, latency, or other third-party conditions may affect service use.
12.User financial funds
Purchasing EFFAP products and services does not involve delivering, placing in custody, or transferring user financial funds to EFFAP for trading purposes. Funds allocated to trading remain subject to the conditions and responsibilities of the account maintained by users with their chosen broker or institution, subject to conditions applicable to the respective service.
13.Understanding and acceptance of risks
Users acknowledge that using automation tools and Copy Trade services related to financial markets involves risks, and that past results, performance histories, simulations, charts, indicators, or other data presented by EFFAP do not guarantee future results. Detailed information on risks associated with products and services is available in EFFAP’s Risk Warning, which users must read before using the services.
14.User responsibility
Users are responsible for information provided, account use, credential security, service configuration, broker selection, maintenance of necessary resources, and monitoring conditions applicable to product use. Users are also responsible for using services according to these Terms, EFFAP instructions, and applicable law.
15.Configuration and use
Correct installation, configuration, and use of products depend on compliance with technical requirements and EFFAP instructions. Incorrect settings, unauthorized changes, incompatibilities, failures in the user’s environment, or use under conditions different from those recommended may compromise service operation and trading results.
16. Subscriptions, plans, and licenses
Subscription-based products and services will be provided according to the plan, period, and conditions selected by users at purchase. Subscription periods, prices, included features, and applicable conditions will be presented before purchase completion and may vary by product, plan, user location, and available payment method.
17.Payments
Payments may be processed by payment providers and financial or payment technology institutions made available by EFFAP, including methods compatible with the user’s location and other options offered. Payment processing is subject to the respective provider’s conditions, checks, policies, and terms, and license or service availability may depend on payment confirmation.
18.Cancellation and termination of subscriptions
Conditions relating to subscription duration, renewal, cancellation, and termination will be presented to users at purchase and are subject to the purchased plan and applicable refund policy. Ending a subscription may result in deactivation of access to the relevant license or service at the end of the purchased period, according to applicable conditions.
19. Refunds and reversals
Any refund, reversal, or return requests will be reviewed according to EFFAP’s Refund Policy, the conditions presented at purchase, and applicable law. Requests relating to payment failures or third-party transactions may also be subject to the respective payment provider’s rules.
20.Intellectual property
All content provided by EFFAP, including software, code, interfaces, text, trademarks, logos, graphics, materials, documents, images, videos, layouts, and other resources, is protected by applicable law and remains the property of EFFAP or its respective owners. Using the services grants users no ownership rights in these elements unless expressly provided.
21. Prohibited uses
Users may not use services for unlawful, fraudulent, or unauthorized purposes, attempt improper system access, interfere with platform operation, reproduce or distribute software without authorization, share credentials or licenses with third parties, exploit vulnerabilities, reverse engineer, or engage in conduct that could harm EFFAP, its users, partners, or suppliers.
22.Service availability and maintenance
EFFAP will seek to keep its services available and operational but does not guarantee uninterrupted or fault-free availability. Scheduled maintenance, updates, technical issues, infrastructure failures, third-party unavailability, external events, or circumstances outside the company’s reasonable control may result in temporary interruptions or access limitations.
23.Software and service updates
EFFAP may make updates, fixes, improvements, technical changes, or modifications to products and services to improve operation, security, compatibility, or performance. Some updates may be necessary for continued software use or compatibility with third-party platforms and services.
24.User support
EFFAP provides support channels according to the conditions presented in the purchased product or plan. Support aims to assist users with service use and does not constitute financial advice, personalized investment recommendations, guarantees of results, or responsibility for users’ trading decisions.
25.Partnerships and broker referrals
EFFAP may maintain commercial relationships or partnership programs with brokers and other service providers used or recommended in connection with its products. Where applicable, EFFAP may receive compensation, commissions, or commercial benefits from referrals or partnerships, without changing users’ responsibility to assess the institution and services used.
26.Limitation of liability
To the extent permitted by applicable law, EFFAP is not responsible for losses arising from user decisions, market conditions, trades in third-party accounts, failures or unavailability of brokers, platforms, servers, payment providers, or other third parties, connection issues, incorrect settings, improper product use, or events outside the company’s reasonable control.
27.Privacy and data protection
EFFAP’s personal data processing will comply with applicable law and conditions described in its Privacy Policy. The Privacy Policy provides detailed information on data collection, use, storage, sharing, protection, and data subject rights.
28. Cookies
The website may use cookies and similar technologies for operation, security, usage analysis, experience improvements, and other purposes described in EFFAP’s Cookie Policy. Where required by applicable law, users may manage their cookie preferences according to the options available on the website.
29. Changes to these terms
EFFAP may periodically update these Terms of Use to reflect changes in services, legal requirements, commercial conditions, technologies, or internal procedures.
